By downloading, accessing, or using the Sex of Heart mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
2. Description of Service
The App is designed for entertainment purposes only. It uses artificial intelligence to analyze electrocardiogram (ECG) data recorded from your smartwatch to provide insights into your sexual makeup, cardiovascular age, and racial makeup. The App does not provide medical advice, diagnosis, or treatment.
3. User Conduct
You agree to use the App only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the App. Prohibited behavior includes, but is not limited to, harassment or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the App.
4. Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App or the server that makes it available are free of viruses or other harmful components.
5. Limitation of Liability
In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the App; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the App; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the App.
6. Indemnification
You agree to indemnify, defend, and hold harmless the developers of the App, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the App.
7. Modifications to the Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developers of the App are based, without regard to its conflict of law principles.
